2. Must a district provide driver's education to a resident student who is open-enrolled to a neighboring district, but who wants the district of residence to provide driver's education?
No. Iowa Code section 321.178 was amended in 2007 to add the following sentence: "The receiving district shall be the school district responsible for making driver education available to a student participating in open enrollment under section 282.18." A resident district may offer driver education to a resident student who is open-enrolled into another district, but does not have to do so. The receiving district must offer driver education to all eligible open-enrolled students.
3. Are home educated students exempt from blood lead testing and the new dental and vision exam requirements?
Legislation enacted by the 2007 Iowa General Assembly requires all children under the age of 6 to have a blood lead test. NICHE has prepared a document called Lead Testing Requirements in Iowa. This document outlines the requirements under this new statue.
Proof of the test is not required to be provided with Competent Private Instruction Report form, but if the family is claiming an exemption, an exemption form is required to be submitted with Form A.
The Iowa Department of Public Health (DPH) plans to cross-check its lists of children tested against lists of children provided by schools. Names of students will not be provided to DPH if the family has directed the school accordingly, with filed Federal Educational Rights & Privacy Act [FERPA] forms.
The new dental screening and vision examinations requirements do not apply to home educated students.
